General Conditions of Sale

These General Conditions of Sale govern the offer and sale of products on the Luxurybrands.it web site.

The products purchased on Luxurybrands.it are sold directly by Fashion Group Italia, owner of the Brand and of the Dominion.

1. Sales Policy

1. Fashion Group Italia offers products for sale on Luxurybrands.it and carries out its electronic commerce only with end users, the "consumers", natural persons who interact with Luxurybrands.it for purposes not pertaining to their regular business or professional activities. Fashion Group Italia therefore reserves the right not to accept orders made by subjects other than "consumers".
2. These General Conditions of Sale apply only to the offer, transmission and acceptance of purchase orders between users and Fashion Group Italia for products sold on Luxurybrands.it.

2. The Purchase Contract

1. To enter into a contract of purchase for one or more products on Luxurybrands.it, users need only complete the electronic order form and send it to Fashion Group Italia by electronic means.
   
   
2. The order form contains the essential information for all products ordered, their price (inclusive of all taxes), the payment method and the shipment and delivery costs.
   
   
3. The contract is entered into when Fashion Group Italia receives an electronic order form and verifies the data to be correct.
   
   
4. The order form is archived in our data bank for the time necessary to deal with the order, and in any event within the terms of law.
   
   
5. Once the contract is entered into, Fashion Group Italia will process the order.
   
   
6. Fashion Group Italia reserves the right to refuse orders that are unreliable, incomplete, incorrect or for products that are no longer available.
   
   
7. If products presented on Luxurybrands.it are no longer available at the time of sending the order form, Fashion Group Italia will inform you immediately, and in any event within 30 days from the day after the order was sent.
   
   
8. If the price was paid at the time of sending the order form, Fashion Group Italia will refund the payment.
   
   
9. By sending the order form you confirm that you understand and accept the present conditions of sale unconditionally.
   
   
10. Once the contract is entered into, Fashion Group Italia will send you by email a receipt for your purchase order with a summary of the information contained in the order form.
    
    

3. Warranties and Prices

1. Fashion Group Italia offers first-quality products and luxury brands on Luxurybrands.it. These products are purchased by Fashion Group Italia directly from selected fashion houses and/or qualified dealers.
   
   
2. Fashion Group Italia does not sell used, irregular or substandard products.
   
   
3. The products' main features are presented on Luxurybrands.it with descriptions and photographs, which, however, depending on the browser or monitor used, may not represent the products precisely.
   
   
4. Fashion Group Italia applies a single-use label to every product that passes quality control.
   
   
5. Do not remove the label unless you are sure of your purchase.
   
   
6. If you decide to exercise your right of withdrawal, Fashion Group Italia has the right not to accept the return of products whose single-use label is missing or has been tampered with, or the return of damaged products.
   
   

4. Payment

1. Payment instructions are shown in the order form.
   
   
2. For credit card payments, information regarding the transaction will be sent using encryption technology to Banca Sella, or any other bank providing the payment services, without being accessible to third parties. Fashion Group Italia shall make no use of that information, except for refunds on returns of goods.
   
   
3. The purchase price and delivery costs will be charged to your account only at the time of shipping the products ordered.
   
   

5. Shipment and Delivery

1. Fashion Group Italia uses SDA for national deliveries and UPS for international deliveries.
   
   
2. When completing the order form, please indicate the address where you are more likely to be found during the day — including your workplace, if authorized.
   
   
3. At least one telephone number is required; it will help us get in touch with you in case the first delivery fails. Undelivered goods will be stored by the carrier for 5 days, after which they will be returned to Fashion Group Italia. Please read this section carefully — it is an essential part of the conditions of sale, which, by sending the order form, you confirm having understood and accepted.
   
   

6. Right of Withdrawal

1. You have the right to withdraw from the contract with Fashion Group Italia and return, in whole or in part, the products purchased without incurring penalties or having to provide reasons, for 10 days after receiving the products. However, you cannot change products with other products.
   
   
2. To withdraw from the contract, send a registered letter with acknowledgement of receipt (A.R.) to: Fashion Group Italia, Customer Service, Via Aspio Terme 24, 60021 Camerano (AN) Italy, providing all information useful for tracing the order. You will receive an email with a consignment note that you must hand over to the carrier together with the goods.
   
   
3. Products being returned to Fashion Group Italia must be consigned to the carrier within 15 days from the date of receipt.
   
   
4. If you return the products through a carrier other than the one indicated by Fashion Group Italia (in Italy, SDA), you will have to bear the delivery costs, in addition to assuming liability for any losses or damages.
   
   
5. As well as the terms above, properly exercising the right of withdrawal requires the following conditions to be respected:
   • The notice of withdrawal must be sent by registered mail with A.R. within 10 days from receiving the products.
     
     
   • The single-use label must be still attached to the product and not have been tampered with.
     
     
   • Items of clothing, footwear and accessories must not be worn, washed or damaged.
     
     
   • The products must be handed over to the carrier within 15 days from the date of receipt.

7. Refund Procedure

1. When receiving the returned products, Fashion Group Italia will inspect them as necessary. If the claims are verified, Fashion Group Italia will send you an email confirming the acceptance of the returned products.
   
   
2. If the receiver of the products is not the same as the payer, in case of withdrawal Fashion Group Italia will refund the payer.
   
   
3. The refund will be in the same currency as the original payment.
   
   
4. These General Conditions of Sale are governed by Italian law, in particular by Legislative Decree no. 185 dated 22 May 1999, concerning distance contracts, and no. 70 dated 9 April 2003, concerning electronic commerce.
   
   
5. In case of disputes, the place of jurisdiction shall be the Court of Ancona.
